These Terms of Use ("Terms") govern your access to and use of Hoshino — our cross-border trading-card price and portfolio platform, including the web app, installable app and public API (together, the "Service"). Please read them carefully. By creating an account or using the Service, you agree to these Terms.

1. Acceptance of terms

By accessing or using the Service, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of a business, you confirm that you are authorized to bind that business to these Terms.

2. Description of the service

Hoshino gives collectors and dealers cross-border price intelligence for trading cards. The Service includes card scanning and identification, real sold-price data by region, a cross-border spread finder (buy-market versus sell-market gaps, net of marketplace fees, shipping and FX), grade-EV estimates ("should I grade this?") across graders such as PSA, CGC, Beckett (BGS) and SGC, portfolio and profit-and-loss tracking, seller tools, alerts, and a public API. Features vary by plan and change over time as we improve the product.

3. Eligibility and accounts

You must be at least 16 years old (or the age of majority where you live) and able to form a binding contract to use the Service. You are responsible for the accuracy of your account information, for keeping your login credentials confidential, and for all activity under your account. Notify us promptly of any unauthorized use. You may not maintain multiple free accounts to evade plan limits.

4. Subscriptions and billing

Hoshino offers a free plan and paid plans. Paid plans are billed in advance on a recurring basis (monthly or annual, as you select) through our payment processor, and renew automatically until you cancel. You can cancel at any time from your account; cancellation stops the next renewal and takes effect at the end of the current billing period, and you keep paid access until then. Prices, plan features and limits are described on our pricing page and may change; we will give notice of material changes to your plan before they take effect. Except where required by law, payments are non-refundable, and downgrading or cancelling does not entitle you to a partial-period refund. You are responsible for any applicable taxes.

5. Acceptable use

You agree to use the Service lawfully and not to:

  • scrape, crawl, harvest or bulk-extract data from the Service outside the API and its documented limits;
  • exceed, circumvent or interfere with API rate limits, quotas or authentication;
  • resell, redistribute or sublicense Hoshino's data feed, prices, spreads or grade-EV output as a competing data product;
  • reverse-engineer, disrupt or attempt to gain unauthorized access to the Service or its infrastructure;
  • upload unlawful, infringing or malicious content, or use the Service to defraud others; or
  • share your account or API keys to give others access that should be paid for.

We may throttle, suspend or terminate access that we reasonably believe breaches these rules or threatens the Service.

6. Important disclaimers

Please read this section carefully.

Hoshino provides market information, not advice. Prices, cross-border spreads, grade-EV figures, population data and any projections are estimates, produced from third-party and collected data. They may be incomplete, inaccurate, delayed or out of date, and actual sale prices, fees, grading outcomes and currency rates will vary. The Service and all data are provided "as is" and "as available," without warranties of any kind, whether express or implied, including accuracy, merchantability or fitness for a particular purpose.

Nothing in the Service is financial, investment, tax or trading advice, and Hoshino is not a broker, dealer, financial adviser or grading company. You are solely responsible for your own buying, selling and grading decisions, and for verifying prices and terms before you act. Trading cards are a speculative, illiquid asset and you may lose money. Use your own judgment.

7. Intellectual property

The Service — including its software, design, text, compiled data, and the Hoshino name and marks — is owned by Hoshino or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service and its outputs for your own collecting or dealing business, subject to these Terms. You keep ownership of the portfolio and content you enter; you grant us the license needed to host, process and display it to operate the Service, and to display content you choose to make public.

8. Third-party marketplaces and links

Hoshino aggregates and links to third-party marketplaces and services. We are not affiliated with, endorsed by, or sponsored by eBay, TCGplayer, Mercari, PSA, CGC, Beckett, SGC or any other marketplace, grader or brand referenced in the Service; their names are used only to identify sources and venues. We do not control third-party platforms and are not responsible for their content, prices, availability, fees, policies, or any transaction you enter into with them. Your dealings with third parties are between you and them.

9. Limitation of liability

To the fullest extent permitted by law, Hoshino and its team will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any lost profits, lost trading gains, or losses arising from decisions you make using the Service or from inaccurate or delayed data. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim, or SGD 100 if you paid nothing. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Indemnity

You agree to indemnify and hold harmless Hoshino and its team from any claims, losses and expenses (including reasonable legal fees) arising from your misuse of the Service, your breach of these Terms, or your infringement of any law or third-party right.

11. Termination

You can stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends; sections that by their nature should survive — including the disclaimers, limitation of liability, intellectual property and governing law — continue to apply.

12. Changes to these terms

We may update these Terms as the Service and the law change. We will update the "Last updated" date above and, for material changes, provide more prominent notice. Your continued use of the Service after changes take effect means you accept the revised Terms.

13. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which Hoshino operates, without regard to conflict-of-law rules. You and Hoshino agree to submit to the exclusive jurisdiction of those courts for any dispute arising out of or relating to these Terms or the Service, except that either party may seek injunctive relief where appropriate. Nothing in these Terms limits any consumer rights you may have under the mandatory laws of your country of residence.
